These Terms of Service govern your access to and use of JetHealth.ai websites, mobile applications, beta applications, TestFlight builds, software, features, content, and related services.

For purposes of these Terms, “JetHealth.ai,” “JetHealth,” “we,” “us,” and “our” refer to JetHealth.ai and its affiliates, successors, assigns, contractors, service providers, and authorized representatives.

By accessing or using JetHealth, creating an account, joining a waitlist, downloading the app, participating in a beta program, or submitting content through the service, you agree to these Terms. If you do not agree, do not use JetHealth

1. The JetHealth Service

JetHealth is a patient-directed technology platform designed to help patients capture, understand, organize, and use information from healthcare conversations as part of their own patient-controlled health memory.

JetHealth may provide features such as:

Recording doctor visits

Uploading recordings, transcripts, PDFs, notes, or other files

Creating transcripts

Generating visit summaries

Creating patient-friendly reports

Extracting health-related categories

Organizing My Health information

Creating clinical-style views

Supporting caregiver or family sharing

Supporting follow-up reminders

Supporting beta or experimental features

Features may change at any time, and not all features may be available in every version, plan, device, geography, beta release, or account configuration.

3. AI and Transcript Limitations

3. AI and Transcript Limitations

JetHealth may use automated tools, transcription systems, language models, artificial intelligence, and related technologies.

These systems can be wrong. They may mishear speech, misidentify speakers, omit information, misinterpret context, summarize incorrectly, generate inaccurate information, create incomplete reports, or use language that sounds confident but is wrong.

You are responsible for reviewing and verifying all JetHealth outputs before relying on them, especially before making or changing any health, medication, treatment, scheduling, or follow-up decision.

4. Recording Consent and User Responsibility

4. Recording Consent and User Responsibility

You are solely responsible for complying with all laws, rules, professional obligations, provider instructions, and facility policies that may apply to recording conversations or uploading recordings. Recording laws vary by state, country, and situation. Some jurisdictions allow one-party consent. Others require consent from all parties. Healthcare providers, clinics, hospitals, facilities, or other participants may also have their own recording policies.

By using JetHealth to record or upload a conversation, you represent and warrant that:

You have the legal right to record and upload the conversation

You obtained any required consent

You will not use JetHealth to violate wiretapping, privacy, confidentiality, or recording laws

You will not use JetHealth to secretly record where prohibited

You will not upload unlawful, abusive, misleading, or unauthorized content

JetHealth encourages respectful disclosure and consent practices in healthcare settings, including telling your provider that you are recording so you can remember the visit and follow through afterward.

5. Accounts and Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and able to form a binding contract to use JetHealth, unless you are using the service under the supervision and authority of a parent or legal guardian. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and keep it updated. You must notify us promptly if you believe your account has been compromised. If JetHealth offers account creation in the app, JetHealth will provide a way to request or complete account deletion within the app or through an accessible account-deletion process where required by Apple policy or applicable law.

6. Minors

JetHealth is not directed to children under 13. If you use JetHealth for a minor child, you represent that you are the child's parent or legal guardian or otherwise have legal authority to provide, record, upload, process, manage, and share that child's information, and that you have obtained any consent required by law.

7. User Content

“User Content” means information you record, upload, submit, generate, store, share, or otherwise provide through JetHealth, including audio recordings, transcripts, summaries, reports, notes, PDFs, documents, provider information, visit metadata, health-related information, feedback, bug reports, and messages. As between you and JetHealth, you retain whatever rights you have in your User Content. You represent that you have all rights, permissions, and authority necessary to record, upload, submit, process, and share User Content through JetHealth.

You grant JetHealth a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, process, transmit, reproduce, modify, analyze, transform, display, generate derivative outputs from, and otherwise use User Content as reasonably necessary to operate, provide, secure, support, improve, and develop JetHealth, including through authorized service providers. This license does not transfer ownership of your User Content to JetHealth. This license includes the right to use User Content as reasonably necessary to:

Provide and operate JetHealth

Process recordings and uploads

Generate transcripts, summaries, reports, and related outputs

Store, sync, export, or return information to your device or account where supported

Support sharing features

Provide customer support

Troubleshoot issues

Maintain security

Prevent fraud or misuse

Comply with law

Improve JetHealth

Develop, test, evaluate, and improve current and future products, services, systems, and AI tools

Create and use de-identified, anonymized, or aggregated data

Perform analytics, research, benchmarking, and product development

Enforce these Terms

This license continues for as long as necessary for the purposes described in these Terms and our Privacy Policy, subject to applicable law and user controls available in the service.

Nothing in these Terms permits JetHealth to use data in a manner prohibited by Apple policies or applicable law. To the extent JetHealth uses Apple-provided health, fitness, medical research, or device frameworks, including HealthKit, Clinical Health Records, Motion and Fitness, MovementDisorder APIs, or similar Apple frameworks, JetHealth will use that data only for purposes permitted by Apple policy, disclosed to users, and authorized by the user.

9. De-Identified and Aggregated Data

9. De-Identified and Aggregated Data

JetHealth may create and use de-identified, anonymized, or aggregated information derived from User Content, usage data, technical data, diagnostic data, metadata, and feedback.

JetHealth may use, disclose, license, or otherwise process de-identified or aggregated information for lawful purposes, including product improvement, AI development, research, analytics, benchmarking, partnerships, and business purposes.

De-identified or aggregated information is not intended to identify you personally, and JetHealth will not attempt to reidentify such information except as permitted by law, such as to test, validate, secure, or improve de-identification processes.

Users may contact legal@jethealth.ai to ask about available opt-out options for future de-identified dataset use, where applicable and technically feasible. To the extent de-identified, anonymized, or aggregated information is derived from Apple health, fitness, medical research, or other Apple framework data, JetHealth will not use or disclose that information for advertising, marketing, use-based data mining, or other prohibited purposes, and will not attempt to re-identify users except as permitted by applicable law and Apple policy.

10. Data Sales and Advertising

Under JetHealth's current model, JetHealth does not sell identifiable patient health data or use identifiable patient health information for targeted advertising. JetHealth will not use data obtained from HealthKit, Clinical Health Records, Motion and Fitness, MovementDisorder APIs, or health-related Apple frameworks for advertising, marketing, or use-based data mining. If JetHealth later offers optional research, advertising-supported, or partnership features, those features must be structured to comply with Apple policies, applicable law, and any required user permission or consent. If JetHealth introduces materially different data practices in the future, such as optional advertising-supported plans, research programs, expanded third-party integrations, or data-sharing features, JetHealth may update its Privacy Policy and these Terms and provide notice and/or obtain consent where required by law before those materially different practices apply.

11. Sharing With Family, Caregivers, and Providers

JetHealth may allow you to share information with family members, caregivers, healthcare providers, specialists, secondopinion providers, or others, and may allow you to manage or revoke access where supported. You are solely responsible for deciding what to share and with whom. JetHealth is not responsible for what recipients do with information after you share it, including whether they copy, forward, store, disclose, or rely on it. You should share health information only with people you trust.

You agree not to:

Use JetHealth unlawfully or in violation of any provider, clinic, hospital, workplace, school, or facility policy

Violate recording, privacy, confidentiality, or wiretapping laws

Upload content you do not have rights to use

Upload malicious code

Interfere with JetHealth systems

Reverse engineer, decompile, disassemble, or attempt to extract source code

Circumvent security controls

Scrape or harvest data

Use JetHealth to harass, threaten, defame, or harm others

Use JetHealth to create, alter, or present misleading, fraudulent, or false medical records

Use JetHealth for emergency medical decisions or as an emergency response, crisis, triage, or urgent-care service

Use JetHealth, User Content, outputs, screenshots, or system behavior to build, train, evaluate, benchmark, or improve a competing product without JetHealth's written permission

Misrepresent AI outputs as official provider records

Use JetHealth in any way that JetHealth determines, in its discretion, could harm users, providers, the company, or the service

Use JetHealth, Apple platform permissions, HealthKit, Apple Health-related data, or any Apple-provided API in a manner that violates Apple policies, applicable law, or user consent.

13. Beta, TestFlight, and Pre-Release Features

13. Beta, TestFlight, and Pre-Release Features

JetHealth may provide beta, pre-release, prototype, or experimental versions through Apple TestFlight or other channels. Beta versions may be incomplete, contain bugs, crash, produce inaccurate outputs, lose data, corrupt data, change without notice, stop working, be removed at any time, or lack final security, privacy, performance, accessibility, or usability features. You use beta versions at your own risk. Beta versions are not intended for critical recordkeeping. You should back up and export any information you want to keep. If you use JetHealth through TestFlight, Apple and JetHealth may receive crash logs, usage data, device information, feedback, screenshots, diagnostic data, and related beta-testing information as permitted by Apple's TestFlight terms and privacy practices. You agree not to publicly disclose confidential, non-public, or pre-release JetHealth features unless JetHealth authorizes disclosure. You will not be compensated for beta testing or feedback unless separately agreed in writing.

14. Feedback

If you provide suggestions, ideas, comments, bug reports, feature requests, screenshots, or other feedback, you grant JetHealth a perpetual, irrevocable, worldwide, royalty-free right to use, modify, publish, commercialize, and incorporate that feedback for any purpose without compensation, attribution, or obligation to you. Feedback and bug reports may be sent to feedback@jethealth.ai.

15. Third-Party Services

JetHealth may rely on third-party services, including app stores, Apple TestFlight, cloud hosting, authentication providers, AI or transcription providers, analytics providers, payment processors, email providers, customer-support tools, data-storage providers, and other technology vendors. Third-party services may have their own terms, privacy policies, security practices, and data-retention practices. JetHealth is not responsible for third-party services except as required by law or applicable agreements. JetHealth is responsible for understanding and accurately disclosing the privacy practices of third-party SDKs, AI providers, analytics tools, infrastructure vendors, and other service providers included in or used by JetHealth, including in the Privacy Policy and App Store privacy information where required. JetHealth will seek user permission where required before sharing personal data with third-party AI, transcription, analytics, or other service providers, and will describe material data sharing in the Privacy Policy or other user-facing disclosures.

16. Apple App Store, TestFlight, Platform Permissions, and Health Data

If you download or use JetHealth through Apple's App Store or TestFlight, Apple's applicable terms, policies, and license agreements may also apply. Apple is not responsible for JetHealth, including support, maintenance, warranties, claims, losses, liabilities, or intellectualproperty matters, except as required by Apple's applicable terms or law. You acknowledge that Apple may be a third-party beneficiary of certain terms applicable to iOS applications where required by Apple's standard terms. Apps made available through the App Store are licensed, not sold. If JetHealth is distributed through the App Store, your use of the app may also be subject to Apple’s standard Licensed Application End User License Agreement or other Apple terms that apply to App Store apps, except to the extent JetHealth provides valid custom terms that supersede or supplement them. If JetHealth requests platform permissions, such as microphone access, notifications, speech recognition, Apple Watch functionality, HealthKit, Apple Health-related integrations, CloudKit, or other Apple frameworks, JetHealth will use those permissions only for the purposes disclosed to users and permitted by Apple policies. JetHealth will make its Privacy Policy available through App Store Connect metadata and in the app in an easily accessible manner where required. JetHealth’s App Store privacy details must be kept accurate and updated to reflect data collected by JetHealth and integrated third-party partners.

17. Subscriptions, Payments, and Billing

JetHealth may offer free, paid, beta, trial, subscription, enterprise, family, caregiver, or other plans. Plan features and pricing may change. If you purchase through Apple, billing, renewals, cancellations, refunds, free trials, subscription management, and payment disputes may be handled by Apple under Apple's policies and your Apple account settings. If you purchase directly from JetHealth, payment terms will be provided at the time of purchase and may include automatic renewal, cancellation, refund, and tax terms.

You are responsible for all applicable taxes and charges. If JetHealth offers auto-renewable subscriptions through Apple, the app or App Store purchase flow will disclose material subscription terms, including price, billing period, renewal behavior, cancellation process, free-trial terms if any, and any features requiring purchase, as required by Apple policies.

By creating an account, joining a waitlist, submitting a form, using the service, or providing contact information, you consent to receive electronic communications from JetHealth. These may include account messages, security notices, legal notices, beta communications, waitlist updates, product updates, support responses, and administrative messages. You may opt out of promotional communications where required by law, but you may still receive essential service or legal communications.

You may stop using JetHealth at any time. JetHealth may suspend or terminate your access at any time, with or without notice, if we believe you violated these Terms, your use creates risk, your use may violate law, your account is compromised, the service is discontinued, or continued access may harm JetHealth, users, providers, service providers, or others. Termination may result in loss of access to information stored in the app or service. You are responsible for exporting or backing up information you want to keep. JetHealth may retain certain information after termination where permitted or required for legal, security, backup, fraud-prevention, dispute-resolution, or business-continuity purposes.

JETHEALTH IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETHEALTH DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION. JETHEALTH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, COMPLETE, RELIABLE, SECURE, AVAILABLE, OR THAT IT WILL MEET YOUR NEEDS OR BE SUITABLE FOR MEDICAL DECISIONS, EMERGENCIES, OR CRITICAL RECORDKEEPING.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETHEALTH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, PERSONAL INJURY, OR MEDICAL DECISION-MAKING DAMAGES ARISING FROM OR RELATED TO YOUR USE OF JETHEALTH.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETHEALTH'S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID JETHEALTH IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR $100. Some jurisdictions do not allow certain limitations, so some limitations may not apply. In those jurisdictions, JetHealth's liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless JetHealth and its officers, directors, owners, employees, contractors, affiliates, service providers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of JetHealth, your User Content, your recordings, your failure to obtain required consent, your violation of recording laws or facility policies, your sharing of information, your violation of these Terms, your violation of law, your misuse of AI outputs, your reliance on JetHealth for medical decisions, or your violation of third-party rights.

Before filing a formal claim, you agree to contact JetHealth at legal@jethealth.ai. You agree to provide a brief description of the issue and allow 30 days for informal resolution. Except where prohibited by law, disputes will be resolved through binding individual arbitration, not class actions or representative proceedings. Nothing in this section prevents either party from bringing an individual claim in small-claims court where permitted. Arbitration will take place in Colorado unless otherwise required by law or agreed in writing. The arbitrator may award individual relief only and may not consolidate claims without the consent of all parties. Either party may seek injunctive or equitable relief in court for intellectual property misuse, security violations, unauthorized access, confidentiality breaches, or similar urgent matters.

To the maximum extent permitted by law, you and JetHealth agree that disputes will be brought only on an individual basis and not as a plaintiff, class member, or representative in any class, consolidated, collective, or representative action.

25. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise. Subject to the arbitration provisions above, courts located in Colorado will have exclusive jurisdiction over disputes that are not subject to arbitration.

JetHealth may modify, suspend, discontinue, or replace any part of the service at any time. JetHealth may update these Terms from time to time, and the updated version will be identified by its effective date or lastupdated date.

Changes are effective when posted unless otherwise stated. Your continued use of JetHealth after changes become effective means you accept the updated Terms. If changes materially affect your rights or our data practices, we may provide additional notice or request consent where required by law.

JetHealth may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or by operation of law. You may not assign these Terms without JetHealth's written consent

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

These Terms, together with the Privacy Policy, any posted supplemental terms, and any additional terms presented to you for specific features or plans, are the entire agreement between you and JetHealth regarding the service.
